There are many things that must be considered when you tell your attorney what should be included in your Last Will and Testament. Some of these things will be fairly easy. Others will require a bit of time to determine . And there may be a few for which deep thought and discussion will be needed. Here are two that often fall into the latter category.
1. Who will be the custodian of the minor children should both parents die? This is a very difficult question that often depends on many factors--the age of the children, which family members or others are available, etc. At a later time, there will likely be formal guardianship proceeding, but this is a way to make your intent known.
2. What happens if both parents and their children die at the same time in a common accident? In such an instance, your estate needs to be dispersed to those who may not have been your first choices. It can be done in any manner you desire and we work together to have your Last Will and Testament reflect your exact desires.
